Court of Protection (COP) Conversations Podcast: accommodation claims and the impact of recent case law on Claimants


Anthony Gold Solicitors are delighted to announce the fifth episode of our Court of Protection Conversations series is now live.

On Friday 5th March 2021, our “COP Conversations: accommodation claims and the impact of recent case law on Claimants” episode went live. Host, Partner and joint Head of Court of Protection, Alexandra Knipe was joined by guest speaker Sheralee Ellis of Chase de Vere.

With over 30 years of experience in financial services, Sheralee has spent the last 23 as an Independent Financial Adviser, advising clients who have suffered life-changing injuries. With particular expertise in advising clients on all financial aspects, such as personal injury trusts to maintain State benefit entitlement, Sheralee is a well-known expert in her field. Throughout her work, Sheralee lays emphasis on empowering and protecting her clients’ given their circumstances.

The COP Conversation episode sees Alexandra and Sheralee discuss topics surrounding the accommodation element of claims in litigated damages cases. The podcast looks at key case law including Roberts v Johnson and Swift v Carpenter, with a focus on how case law has shaped outcomes of accommodation claims. A look into the eagerly awaited judgement of Swift v Carpenter, enabled Knipe and Ellis to reflect on how its verdict will impact future accommodation claims and key considerations advice for Deputies.

Reflecting on the podcast, Sheralee said: “The accommodation element of a damages claim is not an easy problem to solve, this most recent iteration represents only part of the answer whilst trying to be fair to the parties. It therefore remains vital that claimants are able to access specialist independent financial advice so they can receive holistic recommendations on the best way to meet their needs over their lifetime.”

These conversations are vital to supporting and protecting the future of vulnerable clients as well as ensuring they obtain the right amount of funding to help meet their accommodation needs.

Commenting on the podcast, Knipe said:

“The accommodation element of injury claims has for years created complexity; and reform has been advocated by many. It was interesting to talk through some real-life examples as to how Swift might impact on future claims and to have Sheralee’s focused insight on this topic.”
