Can I Claim Compensation?

If you were injured in an accident and someone else was to blame, you can normally claim compensation. Common examples include road traffic accidents, accidents at work and accidents caused by pavements in bad repair, but it is always worth asking an expert whether a claim is possible. The first meeting is completely free. You can bring a claim even if the accident was partly your fault, but the compensation will be reduced to take account of your share of the blame.

Who Pays the Compensation?

Most car drivers, employers, businesses and home owners have insurance to cover them for personal injury claims. It is the insurance company who pays, so you can claim even if the person at fault is a friend or family member.

There are also compensation schemes for the victims of violent crime and “hit and run” drivers.

Can I Claim Against My Employer?

Yes.Your employer will have insurance for this.

Will I Have to Go to Court?

No. Virtually all personal injury compensation claims are settled out of Court.

Can I Wait Before Claiming?

Most claims have to be brought within 3 years, but sometimes a shorter time limit applies. It is best to start as soon as possible, so that photographs can be taken and evidence obtained before things change. We are happy to visit you at home or in hospital if you wish.

What Can I Claim For?

You can claim for:

  • damages for pain, suffering and disability
  • compensation for expenses and other losses incurred
  • compensation for loss of earnings
  • in cases where a relative has died, funeral costs, bereavement damages and compensation for loss of dependency
  • compensation for future losses and expenses where there are ongoing needs

You should keep a record and receipts if possible.

How Much Will I Receive?

This depends on how bad your injuries are and on the amount of your financial losses. You will need expert advice on the value of your claim. Most of our clients receive at least a few thousand pounds.

How Long Will it Take?

This depends on the medical situation and on the attitude of the insurance company. Most claims take at least 6 months if the job is done properly.

How Can I Fund a Case?

We are happy to act for Claimants under conditional fee (“no win, no fee”) agreements. Under these agreements, we are paid nothing if we lose the case. If we win, we claim our costs from the Defendants. In most cases, the Defendants have to pay all the legal costs, but occasionally there is a shortfall which has to be deducted from the compensation.
