Successful settlement for adult client with Downs Syndrome who suffered a personal injury

The Claimant in this case is a 57 year old woman living in a residential home owned and run by the Defendant.

At the time of the accident, decorators had been working at the premises and had removed the door handles from the bathroom and the safety catches from the bathroom windows. Our client entered the bathroom of the premises at some time during the evening, closing the door behind her. Sometime after 11pm, staff at the premises found our client outside on the ground. She had suffered a fractured wrist and grazes to her chest and toes.

On investigation it became clear that our client had become trapped in the bathroom with no door handles to let herself out. Her communication skills were limited and it is thought that she panicked and climbed through the bathroom window and had either jumped or fallen to the ground below, injury herself.

The Defendant initially denied liability, instead blaming the decorators who had been working on the premises. Anthony Gold instructed a private investigator to trace the decorating firm but following a detailed review of the evidence by Counsel (who commented that the accident happened several hours after the decorators had left the premises) the home's insurers were prepared to negotiate a settlement of our client's claim.

The settlement was recently approved by the Court. As our client is 'a person under a disability' her compensation has been invested by the Court and her family will request funds as and when they are required.
