Religious dispute over circumcision of young boy

This 5 day hearing in the High Court was a religious dispute between a Muslim mother and a father who was a member of the Jain sect of Hinduism. The mother wished to have her son circumcised but the father opposed the application as being contrary to his religious beliefs. During their marriage the couple had brought up their children so they were exposed to both religions.

The mother argued that it was necessary, according to her faith, for her son to be circumcised and that this would be rejected by their religious community if he remained uncircumcised.

The Judge ordered that the son should not be circumcised, unless and until he was old enough to make the decision for himself. The children should be brought up with influences from both religions but should not be "converted" to either parent's religion.

The mother applied for permission to appeal against the order but this was refused. She is now considering appealing to the Court of Human Rights.
