Clare Kelly

Partner

Clare Kelly specialises in contentious and non-contentious commercial law and employment law.

She has worked on a variety of commercial transactions including a management buy out, a buy in management/buy out and an asset sale. She undertakes debt collection work for clients of the firm, and has used a variety of enforcement methods to recover many thousands of pounds for clients including gaining charging orders over debtors property, attachment of earnings and bankruptcy.

Clare also undertakes a wide range of contentious probate and Inheritance Act litigation, acting for both claimants and defendants. She has experience of Will disputes, dealing with the construction of Wills and their implementation, as well as with the effects of intestacy. She has recently successfully defended a client against a claim brought by the RSPCA. She also deals with many claims under the Inheritance Act, and has a particular interest in acting for children (often through the Official Solicitor), and for co-habitants in these disputes.

Clare often deals with complex estates where there are multi-party disputes, and often multiple sets of litigation ongoing and is able to deal with, for example, claims relating to proprietary estoppel, breach of trust and claims under the Trusts of Land and Appointment of Trustees Act 1996. She takes a robust and practical view, negotiating and mediating settlements where appropriate and proposing creative settlement solutions.

After graduating with a law degree from University College London, Clare undertook an MA in International Relations and European Studies at the London Centre of International Relations, part of the University of Kent. She then went on to achieve a distinction in her LPC.

She trained with Anthony Gold and qualified as a solicitor in December 2005. She became a Partner in May 2011. She has previously worked in a large international children's charity as an International Project Manager, and as a Project Manager for the LawWorks Clinics project - a joint project between the Law Centres Federation and the Solicitors Pro Bono Group.

Clare speaks conversational French.

Outside of work Clare enjoys travelling and also does voluntary work for a national befriending charity.
