RSPCA case - Judgment of the Court of Appeal

The case went to the Court of Appeal where sadly we lost our case against the RSPCA.

Our client is very disappointed with the judgment of the Court of Appeal and is considering an appeal to the Supreme Court. We believe that the interpretation adopted by the Court, which suggests that the Will should be read first and foremost as an attempt to avoid tax, is incorrect and attributes to the testator an understanding of the technical workings of the Inheritance Tax Act which we do not feel that he had. However, we hope that the uncertainty created by this matter does not prevent people from remembering charities in their Will.
